NYSCAR president's message: Education & Marketing - Hudson Valley

By: Joseph Rowley, Jr. In a matter of weeks NYSCAR and the Hudson Valley Chapter will hold their annual education and marketing event in Fishkill at the Hotel Sierra, April 7-8! Nationally known speaker, Peter Fortunato (Florida) will be the instructor for the April 7th class "Creating Real Estate Transactions that Will Close." Course description: This unique course illustrates the application of practical solutions to developing and structuring commercial-investment transactions. In addition, the class will focus on the "subjectivity of value" as well as the understanding of how to identify the "benefits palette" of a transaction and how the benefits to owners and buyers can best be achieved through the "analysis and distribution of inherent benefits" between the owner/seller and buyer/user/investor so as to generate a mutually beneficial real estate transaction that will result in the ultimate consummation of the transaction. The course will cover the application of the "band of investment theory" beyond its use in valuation and how the development of capitalization rates can best be dissected and creatively applied to better understanding the ability to generate a beneficial transaction for all parties. Also the course will demonstrate how installment sales can be considered, along with documentation, so that both parties in a transaction achieve the desired benefits. Furthermore, the use of "catalysts in the marketplace" and the nature of income, expense analysis, along with the activity and taxability will be discussed. Other topics covered will be utilization of effective transaction documentation, options, proper structuring of promissory notes, performance notes, participation notes, mortgages securing options, use of exchanges and application of master leases, along with case studies and many other brainstorming techniques that can be considered and applied to bring about transactions that can close.
