Brown Altman secures approvals for 4,359 s/f McDonald’s project

Elevation rendering of the re-constructed McDonald’s restaurant and
accessory drive-through at 769 Montauk Highway - East Patchogue, N.Y.

East Patchogue, NY Brown Altman, LLP represented McDonald’s Corp. in securing all necessary approvals to redevelop its restaurant at 769 Montauk Hwy. Founding partner Keith Brown and partner Matthew Ingber navigated this approval process, clearing the way for the demolition of the existing restaurant and the construction of a new 4,359 s/f, one-story McDonald’s with a modernized design, accessory drive-through, and site and landscaping improvements.

The redevelopment site, located at the northwest corner of Montauk Hwy. (CR-80) and Sills Rd. (CR-101), required a change of zone from the J Business 2 Zoning District to the J Business 5 Zoning District, as well as a special permit. The Brookhaven town board granted these approvals and site plan approval on March 25, 2025, with special thanks to councilman Neil Foley, who sponsored the town board resolutions.

In addition to town board approvals, the Brookhaven Board of Zoning Appeals held a public hearing and granted variance relief on May 28, 2025 to erect two new wall signs on the north and south building elevations and a ground sign height increase. Final site plan approval was issued by town planning division on July 3, 2025, and the stamped approved site development plans, prepared by Bohler Engineering, were received two weeks later.

These approvals mark a critical milestone for McDonald’s Corp. as it continues to modernize its restaurants to better serve its customers and meet evolving operational standards.

“We are proud to have secured these complex approvals for McDonald’s,” said Brown. “This outcome reflects our firm’s deep understanding of zoning regulations and our ability to collaborate with town officials, engineers, and corporate stakeholders to achieve results that support economic development and community growth.”

Ingber said “Our team, which included McDonald’s Corp., Bohler and TPD Engineering, worked diligently to design that incorporated feedback from the neighboring property owner and, as the same time, aligned with McDonald’s operational goals and design standards.”

Tri-state capital migrates nationally amid regulation pressure - by Reese Weaver

New York tri-state multifamily investors are increasingly reallocating capital to less-regulated markets across the U.S. as rent control and legislative risk erode returns at home. With over 60% of New York City’s rental housing stock classified as rent-stabilized, the traditional value-add model — buying under-performing buildings,

The death of the generic offering memorandum: What buyers expect in 2025 - by Kimberly Zar Bloorian

There was a time when an offering memorandum (OM) was pretty bare bones, some photos, a few bullet points on income, and a rent roll thrown in at the back. That used to get the job done. Not anymore. In 2025, buyers are sharper, faster, and more selective. They’re looking
