According to Goldberg & Connolly, the firm's managing partner Henry Goldberg addressed the Construction Management Association of America (CMAA) New York/New Jersey chapter at their technical meeting on M/WBE & DBE Best Practices. Goldberg serves as general counsel to the CMAA New York/New Jersey Chapter. The event took place on Thursday, September 13 at the Papillon Bistro.
Goldberg was joined by Goldberg & Connolly's partner Erik Ortmann and associate Christopher Smith for a discussion that included M/WBE and DBE compliance, a pivotal topic among the contracting community. The attorneys discussed certification and requirements, goals, good faith compliance, penalties and communication with agencies and authorities. Discussion also covered the distinctions between city, state and federal guidelines, and provided insight into the investigative process and possible defenses a firm can take should it fail to comply with W/MBE or DBE requirements.
Program highlights included Smith's introduction to new proposed legislation which could potentially change MWBE & DBE regulation, as well as Ortmann's discussion of good-faith compliance, which included a checklist of good faith efforts and other valuable resources, such as a list of minority publications for prime contractors and community organizations. The program was well-attended, and attendees actively participated in the closing question and answer session.
